1. Welcome to Somer, an online real estate platform that provides property listing and search services. By accessing or using our platform, you agree to be bound by these Terms of Service.
2. These terms apply to all users of the platform, including visitors, registered users, property listers, and brokers.
3. Somer reserves the right to modify these terms at any time. Continued use of the platform after changes are published constitutes your acceptance of the updated terms.
4. If you do not agree to any part of these terms, you must discontinue use of the platform immediately.
5. These terms are governed by applicable laws and regulations of the jurisdiction in which Somer operates.

Terms of Use

• The following terms govern your use of the Somer platform and all services provided therein:

1. You must be at least 18 years of age to register and use the platform.
2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
4. Somer reserves the right to suspend or terminate any account that violates these terms without prior notice.
5. You may not use the platform for any unlawful purpose or in violation of any applicable laws or regulations.
6. You agree not to attempt to gain unauthorized access to any part of the platform or its related systems.
7. You may not use automated tools, bots, or scrapers to extract data from the platform without prior written consent.
8. All content submitted by users must be accurate, legal, and not misleading.
9. You agree not to post content that is offensive, discriminatory, or violates the rights of third parties.
10. Somer does not guarantee the accuracy or completeness of any property listings or information provided by users.
11. Property transactions conducted through leads generated on the platform are the sole responsibility of the parties involved.
12. Somer acts solely as an intermediary platform and is not a party to any real estate transaction.
13. You agree to indemnify Somer from any claims arising from your use of the platform or violation of these terms.
14. Somer may display third-party advertisements on the platform; these do not constitute endorsements.
15. You acknowledge that Somer may collect and use data as described in the Privacy Policy.
16. You may not reproduce, distribute, or create derivative works from any platform content without permission.
17. Somer's liability is limited to the fullest extent permitted by applicable law.
18. You agree to use the platform only for legitimate property search, listing, and related real estate purposes.
19. Somer reserves the right to remove any listing or content that violates these terms or applicable law.
20. You acknowledge that internet transmissions are never completely secure and Somer cannot guarantee the security of data.
21. These terms constitute the entire agreement between you and Somer regarding your use of the platform.
22. The following actions are strictly prohibited on the platform:
• Posting false, misleading, or duplicate property listings.
• Soliciting other users for services outside of the platform without authorization.
• Impersonating another person or entity.
23. Somer may update its features, pricing, and services at any time without prior notice.
24. Subscription fees, if applicable, are non-refundable unless otherwise stated in a separate refund policy.
25. Prohibited content categories on the platform include but are not limited to:
• Content that promotes illegal activity.
• Content that infringes intellectual property rights.
• Content containing personal data of third parties without their consent.
• Content that is harmful, abusive, or threatening.
• Content that violates any applicable laws or regulations.
• Spam, unsolicited messages, or commercial content not related to real estate.

Advertising Terms

1. Advertisers must ensure all submitted listings and advertisements are accurate and comply with applicable laws.
2. Somer reserves the right to reject, edit, or remove any advertisement that violates platform policies.
3. Advertised properties must be legally available for sale or rent at the time of listing.
4. Pricing and property details in advertisements must reflect actual market conditions.
5. Advertisers are solely responsible for the content and accuracy of their listings.
6. Duplicate or spam listings will be removed without notice.
7. Advertisers may not include contact information in listing images or titles to circumvent the platform's contact system.
8. Promoted listings are subject to additional terms and payment conditions as outlined at the time of purchase.
9. Somer does not guarantee a specific number of views, leads, or results from any listing or advertisement.
10. Advertisers grant Somer a non-exclusive license to display their content on the platform and its associated channels.
11. Violation of advertising terms may result in immediate removal of listings and suspension of the advertiser's account.

Limitation of Liability

• Somer provides the platform on an "as is" and "as available" basis without warranties of any kind.
• Somer does not warrant that the platform will be uninterrupted, error-free, or free from viruses or harmful components.
• Somer is not responsible for any loss or damage arising from your reliance on information provided on the platform.
• We are not liable for any indirect, incidental, special, or consequential damages resulting from use of the platform.
• Somer is not responsible for the conduct of any user or third party on the platform.
• We do not verify the identity of users or the accuracy of property listings and accept no liability for fraudulent content.
• Any disputes between users and property owners, sellers, or agents are solely the responsibility of the parties involved.
• Somer's total liability shall not exceed the amount paid by you, if any, in the preceding 12 months. This includes but is not limited to:
  1. Loss of profits or revenue.
  2. Loss of data or business interruption.
  3. Personal injury or property damage.
  4. Any other pecuniary loss.
• These limitations apply regardless of whether Somer has been advised of the possibility of such damages.
• Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

User Agreement

1. By using Somer, you confirm that you have read, understood, and agree to be bound by these Terms of Service.
2. You agree to comply with all applicable laws and regulations in your use of the platform.
3. You grant Somer the right to enforce these terms and take necessary action to protect the platform and its users.
4. This agreement may be updated periodically; continued use of the platform after changes constitutes acceptance.

Intellectual Property

1. All content on the Somer platform, including logos, text, graphics, and software, is owned by or licensed to Somer and protected by applicable intellectual property laws.
2. You may not reproduce, modify, distribute, or publicly display any platform content without prior written consent from Somer.
3. Users retain ownership of content they submit, but grant Somer a worldwide, royalty-free license to use, display, and distribute such content on the platform.

Indemnification

1. You agree to defend, indemnify, and hold harmless Somer, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, your listings or content, your violation of these terms, or your infringement of any rights of a third party.

Account Security

1. You are solely responsible for maintaining the confidentiality of your login credentials. Somer will never ask for your password via email or phone.
2. You must notify Somer immediately at support@somer.iq if you suspect any unauthorized use of your account or security breach.
